Modification of Support Payments in Michigan
Michigan law allows for modifications of support payments. Spouses are also able, at the time of the divorce, to waive any right to later modification of support payments when they have negotiated their own settlement agreement. In general, the grounds for modification involve a change in circumstances such as a loss of a home, high costs of maintaining or repairing a home, and legal expenses incurred to enforce child support obligations.
The grounds for terminating spousal support include:
- remarriage of the recipient of the support;
- cohabitation of the recipient of the support;
- fraud, duress, and mutual mistake (these are grounds to set aside an agreement not to terminate support payments in a settlement agreement;)
- change in ability to pay (payor retires or otherwise has lower income);
