Modification of Orders in Michigan
Custodial orders can be changed for cause or because of a change in circumstances that merits change, such as permission to remove a minor from the state, change of custody, an increase or decrease in the amount of child support, a change or termination of spousal support, or a modification of parenting time.
When Parties Move Out of State
When parties who are under a Michigan order to pay child or spousal support move out of state and fail to pay support obligations, there are laws that allow the state to enforce the support orders. All states have passed the Uniform Interstate Family Support Act (UIFSA), which allows Michigan to enforce its support orders against parties who live in or earn income out of state. Under UIFSA, a court in another state may be required to use its laws to withhold the payor's income, enforce the order, modify a support order, or assist in finding the payor's assets.
