Simplified Divorce Procedure in Michigan - Consent Divorce
There is a simplified divorce procedure available in Michigan, which can be achieved by both parties agreeing to:
- sign all required papers;
- the division of all property;
- spousal support arrangements (if any); and
- child custody and support (if any).
The remaining steps for obtaining a simplified divorce include:
- Filing the necessary forms with the clerk of the circuit court, including:
- the Complaint;
- a Verified Statement, Application for IV-D services, and a Uniform Child Custody Jurisdiction Enforcement Act Affidavit, if the couple has minor children;
- the Marital Settlement Agreement
- an Answer and Waiver
- a Judgment of Divorce
- If the couple has minor children, they meet with the Friend of the Court to supply any requested information; and
- The Plaintiff appears before the judge for a short hearing.
