What are the grounds and residency requirements to file for an uncontested or "no-fault" divorce in Michigan?

  1. Either the Plaintiff or the Defendant meet the residency requirement to file for a divorce in the State of Michigan.
  2. There is no other pending or resolved action within the jurisdiction of the family division of the Circuit Court involving the family or family member of the person(s) who is/are the subject of the complaint or petition.
    1. The plaintiff and defendant have no minor children and the wife is not pregnant.

    2. The Plaintiff has not participated in any capacity in other litigation concerning the custody of the minor children in Michigan or other state. -AND- The Plaintiff does not know of any person not a party to these proceedings who has or claims to have physical custody or visitation rights of the minor children.
